The Minister
The Minister for Health, the Hon Dr Kim Hames, MB BS JP MLA, is responsible for Healthway.
The Tobacco Control Act 1990 established the Western Australian Health Promotion Foundation.
The enabling legislation has now been replaced with the Tobacco Products Control Act 2006, which perpetuates the establishment of the Foundation and a Board of Management under S59(1) and S61(1) respectively of the new Act.
The Act defines the role of Healthway in terms of its functions, objectives and powers.
Board of Management
The Healthway Board was established under Section 15 of the Tobacco Control Act 1990 and now operates under Section 59 of the Tobacco Products Control Act 2006. Pursuant to S61(1), the Board consists of 11 members, comprising a Chairperson and 10 nominees of stakeholder groups. The Board represents a mix of government and non-government organisations.
The Board is the accountable authority of Healthway. It sets strategic direction and goals and makes all decisions relating to the allocation of funding for grants and sponsorships. The Board generally meets every 8-9 weeks
As the governing body of Healthway, the Board also has responsibility for:
- co-ordination of planning, policy and the decision making framework;
- compliance with Corporate Governance standards; and
- striving for organisational best practice and customer service.

Tobacco Products Control Act 2006
The proclamation of the Tobacco Control Act 1990 established the Western Australian Health Promotion Foundation and it’s Board of Management.
The enabling legislation has now been replaced with the Tobacco Products Control Act 2006.

Freedom of Information (FOI)
The Freedom of Information Act 1992 (FOI) ensures that members of the public can access the vast majority of records held by Healthway. Wherever possible, Healthway will endeavour to provide access to information without the need to submit a formal FOI request.
Submitting a FOI Request
In the first instance the enquirer should contact Healthway as it may not be necessary to submit a formal FOI request. Should an enquirer wish to proceed with a formal application, then FOI applications must:
- Be in writing;
- Provide sufficient information to identify the documents being requested;
- Provide an Australian address; and
- Lodge the application with a fee of $33 including GST.
Applicants are promptly acknowledged in writing and informed of the decision within 45 days. Should an applicant be dissatisfied with the access decision then the applicant can request an internal review of that decision. The Information Commissioner may also be involved in the review as required.
Documents can be inspected on our premises, posted or sent by facsimile. Additional fees may also apply for copying or transcribing information. These will be charged at cost depending on the type and volume of copying required.

Public Interest Disclosures
The Public Interest Disclosure Act 2003 facilitates the disclosure of public information providing protection for those who make disclosures and those who are the subject of disclosures. Healthway adheres to this process and makes it freely available to employees and members of the public.
